I think it is possible, there isn't any evidence to prove it didn't. There also isn't any evidence to say it did.

Most people seem to think common sense is you wouldn't get into a fight with someone who pointed a gun at you or whom you knew had a gun. Its also hard to imagine that you'd let yourself get beat up for 40 seconds before using it, if you already had it out. All that being said, without any evidence to support it happen, its difficult to make that argument in court.

Because there is no defensive evidence collected from TM and no offensive evidence collected from GZ

Defensive evidence would be any marks or contusions consistent with being struck and no under finger skin scrappings consistent with a defensive posture.
